On Thursday, the House adopted a resolution allowing Speaker Lee Chatfield (R-Levering) to take legal action to challenge Governor Gretchen Whitmer’s authority and actions in response to the COVID-19 pandemic. According to their resolution, Governor Whitmer’s need to declare the states of emergency and disaster are over as of May 1 because the legislature did not vote to extend the declarations past the April 30 deadline. The House is contending that it would be against state law for the governor to extend the declarations of emergency without legislative approval. The move now sets up a legal question on the Governor’s authority which is expected to play out over the next few days.
