Injunction Ordered on State Campaign Finance Law

Last Friday, U.S. District Judge John Corbett O’Meara issued an injunction barring the state from enforcing the recently enacted PA 269.  The bill has created controversy and confusion amongst local governments and the education community since it began moving through the legislative process last year.  Locals took issue with the prohibition on providing information to their residents on upcoming ballot proposals sixty days prior to an election.  Judge O’Meara stated that locals would most likely win their argument that the law is unconstitutional due to its vagueness.

The House has introduced legislation that would allow such communication to occur, but the information provided must remain factual and neutral.  However, some associations are voicing concern with the ambiguity that would be created with the term “neutral.”  This bill remains on the House floor awaiting consideration.
