This week, the House passed legislation introduced by Representative Rob VerHeulen (R-Walker) allowing the legislature to intervene in state court cases when they feel it’s necessary to protect a right or interest of the state. The bill allows for intervention in any state court, during any stage of the proceeding, and applies to all matters pending when the bill takes effect and any thereafter. Supporters of the bill believe it’s important for the legislature to have a voice when there is litigation effecting public policy. However, those opposed feel this is away for the House and Senate to usurp some power from the newly elected Attorney General, who is a member of the Democratic party. The legislation will be sent to the Senate Government Operations Committee for consideration.
