Michigan Attorney General Dana Nessel joined a coalition of 13 other Attorneys General in response to a newer policy limiting civil enforcement of Federal environmental laws. The new policy was issued by the Environmental Protection Agency (EPA) on March 13, in response to COVID-19, but without an end date. In the policy, the EPA states that it does not intend to take enforcement action against companies that, for example, violate existing reporting and monitoring requirements, provided that the companies draw a connection between COVID-19 and their noncompliance, without a requirement for the EPA to justify or explain the impact of the noncompliance.
