Treasury Provides Exemption for PPE

The Department of Treasury issued a revenue administrative bulletin this week addressing the application of the sales and use tax industrial processing exemption to personal protective equipment (PPE) and safety equipment used to prevent the spread of COVID-19. PPE equipment is eligible for the industrial processing exemption if it meets all of the below criteria:

1. It is purchased by the industrial processor or another person engaged in an industrial processing activity on behalf of an industrial processor, including purchases made directly by an employee of an industrial processor;
2. It is used for the safety of employees or other authorized personnel; and
3. It is used in an industrial processing activity.
