This week, the Senate Government Operations Committee reported legislation allowing the legislature to intervene in court cases when they feel it’s necessary to protect a right or interest of the state. As passed by the House last week, the bill allows for intervention in any state court, during any stage of the proceeding, and applies to all matters pending when the bill takes effect and any thereafter. Prior to being reported from the Senate committee, several changes were made to the bill, including clarification the proposal won’t limit the Michigan Attorney General’s powers.Opponents had been voicing concerns that this legislation would limit the powers of the Attorney General, who come January will be a Democrat.Additionally, the substitute clarifies in what cases the legislature can intervene. The bill has been referred to the Senate floor for consideration.
